He&#8217;s facing a number of serious criminal\u2014and civil\u2014charges.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Exactly one year after the company <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/decrypt.co\/105076\/troubled-crypto-lending-platform-celsius-files-for-bankruptcy\" class=\"sc-adb616fe-0 ePvUAp\">went bust<\/a>the feds on thursday <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/decrypt.co\/148431\/sec-sues-bankrupt-crypto-lender-celsius-network-ceo-alex-mashinsky\" class=\"sc-adb616fe-0 ePvUAp\">arrested<\/a> Mashinsky and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/decrypt.co\/148450\/feds-hit-former-celsius-ceo-alex-mashinsky-with-seven-criminal-charges\" class=\"sc-adb616fe-0 ePvUAp\">hit<\/a> him with seven criminal charges, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/celsius-founder-and-former-chief-revenue-officer-charged-connection-multibillion\" class=\"sc-adb616fe-0 ePvUAp\">alleging<\/a> he pocketed $42 million by defrauding customers.  He pleaded not guilty later on Thursday and is due to be released on bail after agreeing to a $40 million personal recognizance bond.<\/p>\n<p><span class=\"\" style=\"display:inline-block\"\/><\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">They also charged his colleague, ex-chief revenue officer, Roni Cohen-Pavon, with four criminal counts.  Israeli Cohen-Pavon is currently abroad, according to the DOJ.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Celsius was also hit with three other lawsuits by the Securities and Exchange Commission, the Commodity Futures Trading Commission and the Federal Trade Commission.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Authorities allege that Celsius promised to be a &#8220;modern day bank&#8221; and the &#8220;safest place&#8221; for customers&#8217; crypto but was instead a company in a &#8220;dire financial situation.&#8221;<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Here is a breakdown of all the lawsuits.<\/p>\n<p class=\"sc-a2026f0f-3 kSJGyr gg-dark:text-white scene:font-itc-avant-garde-gothic-pro scene:font-light\" style=\"margin-top:2em;text-align:left\" color=\"#333\" opacity=\"1\">US Department of Justice<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The most serious allegations are the criminal ones.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\"><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/media\/1305431\/dl?inline\" class=\"sc-adb616fe-0 ePvUAp\">Accordingly<\/a> to the US Attorney&#8217;s Office for the Southern District of New York indictment unsealed Thursday, prosecutors allege that Mashinsky, Cohen-Pavon, and others at Celsius, &#8220;orchestrated a yearslong scheme&#8221; to make it seem that Celsius&#8217; assets were more valuable than they were .<\/p>\n<div class=\"relative w-full\">\n<blockquote class=\"twitter-tweet mx-auto\">\n<p lang=\"en\" dir=\"ltr\">US Attorney Damian Williams on today&#8217;s indictment against Alexander Mashinsky and Roni Cohen-Pavon: \u201cExactly one year ago today, Celsius Network, a crypto platform that, at its height, managed approximately $25 billion in customer assets, filed for bankruptcy protection 1\/6<\/p>\n<p>\u2014 US Attorney SDNY (@SDNYnews) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SDNYnews\/status\/1679530873400565760?ref_src=twsrc%5Etfw\" data-wpel-link=\"internal\">July 13, 2023<\/a><\/p>\n<\/blockquote>\n<\/div>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">This pumped up the price of the company&#8217;s native token CEL so they could allegedly cash it out at inflated prices.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">&#8220;Mashinsky personally reaped approximately $42 million in proceeds from his sales of CEL, and Cohen-Pavon personally reaped at least $3.6 million in proceeds from his sales of CEL,&#8221; the indictment reads.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">When 2022 came around and the value of the digital asset market was slumping, Celsius \u201ccould not withstand the drop in crypto asset prices.\u201d  But Mashinsky continued to claim that the platform was safe and customers should deposit their crypto there, prosecutors allege, even as Mashinsky himself had cashed out.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">And it had been a long time coming.  &#8220;The efforts of Alexander Mashinsky, the defendant, to deceive the public about the reliability and profitability of Celsius&#8217; model began near its inception,&#8221; Thursday&#8217;s indictment said.<\/p>\n<p class=\"sc-a2026f0f-3 kSJGyr gg-dark:text-white scene:font-itc-avant-garde-gothic-pro scene:font-light\" style=\"margin-top:2em;text-align:left\" color=\"#333\" opacity=\"1\">Securities and Exchange Commission<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Wall Street&#8217;s biggest regulator also sued Celsius and Mashinsky on Thursday.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The SEC <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sec.gov\/files\/litigation\/complaints\/2023\/comp-pr2023-133.pdf\" class=\"sc-adb616fe-0 ePvUAp\">said<\/a> that the collapsed crypto lender repeatedly lied to customers about how safe the platform was, claiming that it had received approval from state and federal regulators when this wasn&#8217;t the case.  It also allegedly flogged unregistered securities.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The regulator also alleged that Celsius didn&#8217;t have one million users\u2014as the company said back in 2021\u2014but rather 500,000.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">And despite the fact that Celsius started to collapse in 2022, and a report circulated in the company acknowledged this, the lender &#8220;told the investing public a very different story,&#8221; according to the SEC complaint.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Mashinsky even allegedly said that Celsius had not &#8220;experienced any significant losses&#8221; even though the platform &#8220;incurred losses of more than $800 million in 2021 and an additional $165 million during the first quarter of 2022,&#8221; the SEC wrote.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The SEC charges include the unregistered offer and sale of crypto asset securities through Celsius&#8217;s lending program, making false and misleading statements, and engaging in market manipulation.  The regulator also asked a court to bar him from serving as an officer or director of a public company in the future.<\/p>\n<p class=\"sc-a2026f0f-3 kSJGyr gg-dark:text-white scene:font-itc-avant-garde-gothic-pro scene:font-light\" style=\"margin-top:2em;text-align:left\" color=\"#333\" opacity=\"1\">Federal Trade Commission<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The F.T.C. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/2223137celsiusnetworkcomplaint.pdf\" class=\"sc-adb616fe-0 ePvUAp\">allegedly<\/a> Thursday that Celsius &#8220;duped consumers&#8221; who didn&#8217;t know much about crypto to deposit their assets and then &#8220;squandered&#8221; their investments.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Like the DOJ and SEC complaints, the FTC alleged that Celsius Network and Mashinsky lied and repeatedly misled investors.  The lawsuit also included co-founders Shlomi Daniel Leon and Hanoch &#8220;Nuke&#8221; Goldstein.<\/p>\n<div class=\"relative w-full\">\n<blockquote class=\"twitter-tweet mx-auto\">\n<p lang=\"en\" dir=\"ltr\">FTC reaches settlement with crypto platform Celsius Network;  Charges former executives with duping consumers into transferring cryptocurrency into their platform and then squandering billions in user deposits: <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/zkigpfHneU\" data-wpel-link=\"internal\">https:\/\/t.co\/zkigpfHneU<\/a><\/p>\n<p>\u2014 FTC (@FTC) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/FTC\/status\/1679490051141513217?ref_src=twsrc%5Etfw\" data-wpel-link=\"internal\">July 13, 2023<\/a><\/p>\n<\/blockquote>\n<\/div>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">\u201cThey failed to maintain enough liquid cryptocurrency to allow all customers to<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">withdraw their crypto on demand,\u201d the complaint said.  &#8220;Defendants concealed these facts from the public and falsely touted Celsius as a safe alternative to banking\u2014even though it was anything but.&#8221;<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Later on Thursday, the FTC <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/07\/ftc-reaches-settlement-crypto-platform-celsius-network-charges-former-executives-duping-consumers\" class=\"sc-adb616fe-0 ePvUAp\">announced<\/a> a settlement with Celsius, including a $4.7 billion fine\u2014and banning Celsius and its affiliates from offering, marketing, or promoting any product or service that could be used to deposit, exchange, invest, or withdraw any assets.<\/p>\n<p class=\"sc-a2026f0f-3 kSJGyr gg-dark:text-white scene:font-itc-avant-garde-gothic-pro scene:font-light\" style=\"margin-top:2em;text-align:left\" color=\"#333\" opacity=\"1\">Commodity Futures Trading Commission<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">The CFTC also on Thursday <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/8749-23\" class=\"sc-adb616fe-0 ePvUAp\">Charged Mashinsky<\/a> and Celsius with fraud and material misrepresentations in connection with the operation of its digital asset-based finance platform.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">In short, Celsius lied to its customers, the CFTC alleged.  Mashinsky was even told not to keep telling customers lies, according to the Thursday complaint.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">&#8220;Mashinsky had been told by Celsius senior management that his statements about Celsius&#8217;s leverage were false and that Mashinsky should cease from making these misrepresentations to the public,&#8221; it read.<\/p>\n<p class=\"font-meta-serif-pro scene:font-noto-sans scene:text-base scene:sm:text-lg font-normal text-lg md:text-xl md:leading-9 tracking-px text-body gg-dark:text-neutral-100\">Despite this, Mashinsky continued to allegedly mislead the public.  In one instance, he claimed he was holding CEL because its value was going up.
