The two lawmakers are the respective chairs of subcommittees on Digital Assets, Financial Technology and Inclusion and Commodity Markets, Digital Assets, and Rural Development with the House Financial Services Committee and House Agriculture Committee.<\/p>\n<p>\u201cLegislation would do far more to prevent future collapses of digital asset firms than enforcement actions,\u201d said the letter.  \u201cA statutory framework would establish a process for firms to come into the regulatory parameter and comply with consumer protections, rather than relying on enforcement actions to punish a bad actor after the damage has already been done.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">The SEC cannot continue to regulate by enforcement. Hill and Johnson hinted at certain actions by the SEC &#8220;seemingly timed to coincide with related Congressional activity, which appears calculated for maximum publicity and political impact&#8221;.  Other members of Congress have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/us-lawmakers-question-sec-chair-on-timing-of-sam-bankman-fried-s-arrest\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/us-lawmakers-question-sec-chair-on-timing-of-sam-bankman-fried-s-arrest\/amp\">questioned Gensler on the timing.<\/a> of the SEC&#8217;s charges against former FTX CEO Sam Bankman-Fried, given he had been scheduled to testify before the House Financial Services Committee in December 2022.<\/p>\n<p><strong><em>Related: <\/em><\/strong><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/sec-chair-gensler-offered-serve-advisor-to-binance-lawyers-claim\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/sec-chair-gensler-offered-serve-advisor-to-binance-lawyers-claim\/amp\"><strong><em>SEC&#8217;s Gensler offered to serve as an advisor to Binance in 2019, lawyers claim<\/em><\/strong><\/a><\/p>\n<p>The two lawmakers also referenced a &#8220;recent summary judgment&#8221; affecting crypto regulation, likely referring to an <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/sec-vs-ripple-huge-win-for-crypto\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/sec-vs-ripple-huge-win-for-crypto\/amp\">SEC v.  Ripple ruling<\/a> suggesting XRP was not necessarily a security.  In the wake of the court decision, other House Representatives have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/lawmaker-calls-sec-chair-reassess-stance-crypto-following-ripple-ruling\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/lawmaker-calls-sec-chair-reassess-stance-crypto-following-ripple-ruling\/amp\">called on Gensler<\/a> to consider the commission&#8217;s current approach to regulating crypto.  The SEC chair said he was &#8220;disappointed&#8221; in the ruling. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/sec-chair-gary-gensler-reaction-to-ripple-decision-is-mixed-still-under-consideration\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/sec-chair-gary-gensler-reaction-to-ripple-decision-is-mixed-still-under-consideration\/amp\">due to its impact<\/a> on retail investors, and the commission would be assessing the situation. <\/p>\n<p>Lawmakers in the House Financial Services Committee are considering a draft market structure bill. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/crypto-u-s-industry-watchdogs-oppose-draft-bill-on-crypto-market-structure\" data-amp=\"https:\/\/cointelegraph-com.cdn.ampproject.org\/c\/s\/cointelegraph.com\/news\/crypto-u-s-industry-watchdogs-oppose-draft-bill-on-crypto-market-structure\/amp\">aimed at clarifying the roles<\/a> the SEC and Commodity Futures Trading Commission would play in regulating crypto.
