{"id":125352,"date":"2023-07-21T03:58:56","date_gmt":"2023-07-21T03:58:56","guid":{"rendered":"https:\/\/dripp.zone\/news\/coin-center-and-blockchain-association-slam-unworkable-us-senate-defi-bill-crypto-news\/"},"modified":"2023-07-21T03:58:58","modified_gmt":"2023-07-21T03:58:58","slug":"coin-center-and-blockchain-association-slam-unworkable-us-senate-defi-bill-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/coin-center-and-blockchain-association-slam-unworkable-us-senate-defi-bill-crypto-news\/","title":{"rendered":"Coin Center and Blockchain Association slam &#8216;unworkable&#8217; US Senate DeFi bill\n &#8211; Crypto News"},"content":{"rendered":"<div data-v-2649fa34=\"\">\n<p>Crypto industry advocacy bodies have slammed a newly proposed United States Senate bill for what they say is a confused approach to regulating the decentralized finance (DeFi) sector.<\/p>\n<p>On July 20, crypto think tank Coin Center and crypto advocacy group the Blockchain Association released separate statements describing the legislation as a \u201cmessy,\u201d \u201cunworkable,\u201d and \u201cunconstitutional\u201d way of regulating DeFi. <\/p>\n<p>Introduced on July 18, the bipartisan Crypto-Asset National Security Enhancement Act (CANSEE) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/bipartisan-bill-regulate-defi-crypto-security-risks-introduced-us-senate\">bill aims to reign in money laundering<\/a> violations in DeFi. <\/p>\n<p>If passed, the legislation would extend new penalties to anyone who &#8220;controls&#8221; or &#8220;makes available an application designed to facilitate transactions using a digital asset protocol.&#8221;  They would also be required to adhere to anti-money laundering and financial reporting standards. <\/p>\n<p>The definition of who or what \u201ccontrols\u201d a DeFi protocol was left to be made by the US Secretary of the Treasury \u2014 a move some pundits say will lead to excessive controls being applied to DeFi.<\/p>\n<p>In its July 20 blog <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coincenter.org\/the-cansee-act-is-a-messy-arbitrary\/\">posts<\/a>Coin Center wrote the bill gives &#8220;virtually unbounded discretion to the Secretary to decide what it would take to designate one as having &#8216;control&#8217; of a protocol.&#8221;<\/p>\n<p>Additionally, the think tank declared the bill to be unconstitutional as it would crack down on software developers who\u2014as an extension of free speech\u2014have a First Amendment right to publish code.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">We&#8217;ve looked at the new bill by <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenJackReed?ref_src=twsrc%5Etfw\">@SenJackReed<\/a>, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenatorRounds?ref_src=twsrc%5Etfw\">@SenatorRounds<\/a>, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenatorWarner?ref_src=twsrc%5Etfw\">@SenatorWarner<\/a>,<br \/>and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/SenatorRomney?ref_src=twsrc%5Etfw\">@SenatorRomney<\/a> that would extend sanctions penalties and AML obligations to developers of decentralized protocols.  It&#8217;s unconstitutional and ill-considered.
