As reported on July 18, Nevada courts ordered Prime Trust into temporary receivership, signaling the serious financial difficulties it faced.<\/p>\n<p>The company\u2019s financial deficit in July reportedly <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/nevada-court-orders-prime-trust-into-temporary-receivership\/\">exceeded<\/a> $82 million. As of the Chapter 11 filing, the consolidated list of the top 50 unsecured creditors totals $144 million.<\/p>\n<p>Further, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cases.stretto.com\/primetrust\/court-docket\/voluntary-petitions\/\">across four filings<\/a> for Prime Trust group companies, Prime Core Technologies Inc., Prime Digital, LLC, Prime IRA LLC, and Prime Trust, LLC, there are liabilities recorded to be $100 million and $500 million, and assets between $50 million and $100 million.<\/p>\n<figure id=\"attachment_350045\" aria-describedby=\"caption-attachment-350045\" style=\"width: 1024px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"lazyload size-large wp-image-350045\" src=\"https:\/\/cryptoslate.com\/wp-content\/uploads\/2023\/08\/Screenshot-2023-08-15-093830-1024x528.png\" alt=\"prime trust bankruptcy\" width=\"1024\" height=\"528\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption id=\"caption-attachment-350045\" class=\"wp-caption-text\">Source: Chapter 11 filing<\/figcaption><\/figure>\n<p>The potential impact on the industry could be significant, given its pivotal role in providing custodial services to institutional crypto investors.<\/p>\n<p>Prime Trust is a \u2018qualified custodian,\u2019 meaning that all customer custodied assets should be protected from the bankruptcy of the custodian. <em>CryptoSlate<\/em> has reached out to Prime Trust for confirmation but has yet to receive a response as of press time.<\/p>\n<h2>Chapter 11 decision.<\/h2>\n<p>The decision to file for Chapter 11 bankruptcy follows the permanent appointment of former banking executive John Guedry as receiver for the company. Guedry, along with John Wilcox and Michael Wyse, form a special restructuring committee with the authority to oversee the company\u2019s ongoing bankruptcy cases.<\/p>\n<p>As the company continues to operate as \u201cdebtors-in-possession,\u201d it intends to file several motions with the Bankruptcy Court to facilitate the \u201corderly evaluation of all strategic alternatives.\u201d These measures could potentially include selling the company\u2019s assets and operations as a going concern.<\/p>\n<p>Prime Trust\u2019s financial crisis, initiated nearly a month before the receivership order, has ripple effects within the crypto industry.<\/p>\n<p>It began with the Nevada Financial Institutions Division (NFID) issuing a cease and desist order on June 21 due to the company\u2019s inability to fulfill customer withdrawal requests.<\/p>\n<p>This was shortly followed by the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/prime-trust-subsidiary-banq-declares-bankruptcy\/\">bankruptcy<\/a> declaration of Prime Trust subsidiary Banq on June 14 and the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/bitgo-backs-out-of-deal-to-acquire-prime-trust\/\">termination<\/a> of BitGo\u2019s planned acquisition of Prime Trust on June 22.<\/p>\n<p>Further details related to the court-supervised proceedings will be made available as the proceedings unfold.
