{"id":137513,"date":"2023-09-02T05:36:27","date_gmt":"2023-09-02T00:06:27","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=137513"},"modified":"2023-09-02T05:36:27","modified_gmt":"2023-09-02T00:06:27","slug":"mchenry-questions-timing-of-prometheums-special-purpose-broker-dealer-approval-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/mchenry-questions-timing-of-prometheums-special-purpose-broker-dealer-approval-crypto-news\/","title":{"rendered":"McHenry questions timing of Prometheum\u2019s special purpose broker-dealer approval &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<div>\n<p>Patrick McHenry R-N.C., Chair of the House Financial Services Committee, along with other members of Congress, sent letters to Robert Cook, CEO of the Financial Industry Regulatory Authority (FINRA) and US Security and Exchange Commission chair Gary Gensler on Tuesday.<\/p>\n<p>McHenry asked Cook and Gensler to break down how Prometheum was approved as a special purpose broker-dealer. They also questioned the ties that Prometheum reportedly has to the Chinese Communist Party.<\/p>\n<p>Legislators also <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/financialservices.house.gov\/news\/documentsingle.aspx?DocumentID=408950\">asked<\/a> about the timing of the approval, saying that it \u201craises concerns that it was aimed at demonstrating that legislation is not needed because there is a workable regulatory framework for the custody of digital asset securities.\u201d<\/p>\n<p>Prometheum was granted approval on May 17 of this year, and legislation was released on June 2.\u00a0\u00a0<\/p>\n<p>In the letter to Cook, they asked <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/finra\">FINRA<\/a> to supply a briefing to the House Financial Services Committee by Aug. 22, though they\u2019d appreciate a response as soon as possible.<\/p>\n<p>In the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/financialservices.house.gov\/uploadedfiles\/2023-08-09__fsc_gop_letter_to_finra_re_prometheum.pdf\">letter<\/a>, the Committee asked for the number of special purpose broker-dealer applications, how many applications have been denied, and what risks were assessed prior to approving Prometheum.\u00a0<\/p>\n<p>Additionally, politicians asked for documentation related to the application, and communications both within FINRA and with the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/sec\">SEC<\/a> on the applications.<\/p>\n<p>While the letter to the SEC did not include the same questions as McHenry posed to FINRA, it did request documents and communications related to the application.<\/p>\n<p>\u201cIn fact, you have touted the Prometheum approval multiple times in public statements to support your position that digital asset firms can comply with the existing regulatory framework,\u201d Committee members <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/financialservices.house.gov\/uploadedfiles\/2023-08-09_fsc_gop_letter_to_sec_re_prometheum.pdf\">wrote<\/a> to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/gary-gensler\">Gensler<\/a>.\u00a0<\/p>\n<p>During his testimony to the Committee earlier this year, Aaron Kaplan, CEO of Prometheum, stated that 20% of his company is owned by Shanghai Wanxiang Blockchain Inc and that \u201caccording to SEC filings, a representative of that entity, Feng Ziao, serves as a director in Prometheum.\u201d<\/p>\n<p>Prometheum and Wanxiang entered into a 2018 agreement to develop blockchain trading software, but the agreement was later terminated.\u00a0<\/p>\n<p>\u201cPrometheum\u2019s former relationships with Wanxiang and its affiliates have been reviewed by the SEC, which closed its investigation, and CFIUS, which never opened up a formal investigation,\u201d Prometheum said in an emailed statement to Blockworks.<\/p>\n<p>\u201cPrometheum purpose-built its technology with the goal to develop a market infrastructure for digital asset securities that is compliant with the federal securities laws. This technology will serve as a building block for a compliant and orderly digital asset securities marketplace that protects investors and serves their best interests.\u201d<\/p>\n<p>McHenry isn\u2019t the only one concerned with the Prometheum approval. In July, Representative Ritchie Torres D-N.Y. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/news\/ritchie-torres-prometheum-letter\">asked the SEC<\/a> to open an investigation into how the company \u2014 which \u201chas not yet served a single customer\u201d according to McHenry\u2019s letters \u2014 was granted a license.<\/p>\n<p>The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/blockchain-association\">Blockchain Association<\/a> has also <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/news\/prometheum-sec-broker-dealer-investigation\">expressed its concern<\/a> over the alleged \u201csweetheart\u201d deal between Prometheum and the SEC.<\/p>\n<p><em>Updated Tuesday, August 15 at 5:20 pm ET: Added statement from Prometheum<\/em><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n<p><strong>Get the day\u2019s top crypto news and insights delivered to your email every evening.\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/newsletter?source=end\">Subscribe to Blockworks\u2019 free newsletter<\/a>\u00a0now.<\/strong><\/p>\n<p><strong>Want alpha sent directly to your inbox?
