{"id":144310,"date":"2023-09-01T16:19:26","date_gmt":"2023-09-01T10:49:26","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=144310"},"modified":"2023-09-01T16:19:26","modified_gmt":"2023-09-01T10:49:26","slug":"prosecutors-rebuff-complaints-from-bankman-frieds-lawyers-regarding-excessive-evidence-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/prosecutors-rebuff-complaints-from-bankman-frieds-lawyers-regarding-excessive-evidence-crypto-news\/","title":{"rendered":"Prosecutors rebuff complaints from Bankman-Fried\u2019s lawyers regarding excessive evidence &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<p>U.S. prosecutors responded to complaints from accused former FTX CEO <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/people\/sam-bankman-fried\/\">Sam Bankman-Fried<\/a> and his legal team in a filing on <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.courtlistener.com\/docket\/66631291\/237\/united-states-v-bankman-fried\/\">Aug. 29<\/a>.<\/p>\n<p>Bankman-Fried and his team previously objected to the government\u2019s decision to provide large amounts of discovery materials in the weeks leading up to trial.<\/p>\n<p>In a recent filing dated <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.233.0.pdf\">Aug. 28<\/a>, Bankman-Fried\u2019s lawyers noted that the government provided about 7.7 million pages of discovery materials over a matter of days. The lawyers also complained that their client had no practical way to review those documents due to his imprisonment and other related factors.<\/p>\n<p>Government prosecutors, however, say that those complaints are \u201cdistorted.\u201d Prosecutors admitted that they were delayed in providing 4 million pages of discovery due to production issues at Google. However, they said that Bankman-Fried should have been able to review those documents in preparation for his defense for several months because the materials in question originated from his own Google accounts.<\/p>\n<p>The prosecutors also claimed Bankman-Fried may be seeking evidence in order to engage in witness tampering, writing that the former CEO had \u201cidentified documents from his Google accounts that he believed would discredit one of the Government\u2019s cooperating witnesses and provided them to a widely read publication.\u201d<\/p>\n<p>That comment seemingly refers to Bankman-Fried\u2019s disclosures about former Alameda Research CEO <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/people\/caroline-ellison\/\">Caroline Ellison<\/a>, who is set to serve as a star witness. <em>The New York Times<\/em> printed a story on Ellison based on Bankman-Fried\u2019s information in <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptoslate.com\/caroline-ellisons-private-writings-in-months-before-alameda-ftx-collapse-uncovered-in-discovery-process\/\">July<\/a>.<\/p>\n<h2>Some discovery materials are duplicates<\/h2>\n<p>Prosecutors additionally said that 3.7 million pages of discovery are duplicate documents and do not increase the total amount of discovery materials. They said those documents were merely meant to notify Bankman-Fried of documents that would be included in future discovery and insisted that Bankman-Fried and his legal team were \u201cliterally double counting\u201d discovery materials in this regard.<\/p>\n<p>Bankman-Fried\u2019s lawyers previously asked for courts to prevent the government from introducing evidence produced after July 1, 2023.
