{"id":144891,"date":"2023-09-01T15:17:54","date_gmt":"2023-09-01T09:47:54","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=144891"},"modified":"2023-09-01T15:17:54","modified_gmt":"2023-09-01T09:47:54","slug":"judge-pushes-sam-bankman-frieds-legal-team-to-consider-asking-for-an-extension-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/judge-pushes-sam-bankman-frieds-legal-team-to-consider-asking-for-an-extension-crypto-news\/","title":{"rendered":"Judge pushes Sam Bankman-Fried\u2019s legal team to consider asking for an extension &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<div>\n<p>Judge Lewis Kaplan, who is overseeing the US case against Sam Bankman-Fried, is pushing the former FTX CEO\u2019s legal team to consider an extension after they filed multiple letters complaining about millions of pages of discovery given to them by the US earlier this week.<\/p>\n<p>According to filings, the US has handed over nearly eight million pages in discovery.\u00a0<\/p>\n<p>The issue isn\u2019t just about the volume of discovery, which the government attributes to a mishap with Google, but also the alleged inability of Bankman-Fried to review the discovery.<\/p>\n<p>\u201cThe plan is plainly inadequate and violates Mr. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/sam-bankman-fried\">Bankman-Fried\u2019s<\/a> Sixth Amendment right to participate in preparing his defense and his right to receive effective assistance of counsel,\u201d the lawyers said earlier this week.<\/p>\n<p>Bankman-Fried\u2019s bail was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/news\/sbf-bail-decision#:~:text=Sam%20Bankman%2DFried's%20bail%20has,for%20October%20of%20this%20year.\">revoked in early August by Judge Kaplan<\/a>, and he\u2019s been detained at the Manhattan Detention Complex (MDC) since then.\u00a0<\/p>\n<p>His lawyers claim that he can\u2019t dedicate meaningful time to his case. This has resulted in multiple letters from both the defense and the government being submitted to the Court.<\/p>\n<p>While the Court declined to rule on a temporary release for the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/tag\/ftx\">FTX<\/a> founder during the Wednesday hearing, the judge asked both sides to put together a joint report on the state of Bankman-Fried\u2019s <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blockworks.co\/news\/sbf-lawyer-temporary-release\">accessibility to his defense preparation<\/a>, which they are expected to file by Tuesday, Sept. 7.\u00a0\u00a0<\/p>\n<p>Kaplan said he wants to know \u201cwhat\u2019s in place, what works, and if anything doesn\u2019t work, [he] want[s] to know about that, too.\u201d<\/p>\n<p>Additionally, the judge asked Bankman-Fried\u2019s lawyers to consider asking for an extension ahead of Oct. 3 trial date following his dismissal of the in limine motion. Lawyers had previously sought the in limine motion to attempt to block the US from using the newer discovery in the trial.\u00a0<\/p>\n<p>Kaplan urged the defense to file any motion for postponement by the end of this week, but also noted that he may not grant it because there has to \u201cbe more meat on those bones to make out the kind of case that defendants are putting to me.\u201d<\/p>\n<p>Judge Kaplan indicated that a delay might be granted after this week, without specifying a hard deadline. However, he emphasized that a jury request must be made by Sept. 7.
