Sam Bankman-Fried, the founder and former CEO of defunct cryptocurrency exchange FTX,\u00a0filed<\/a> a memorandum on Sep. 1 asking the court to deny the prosecutor\u2019s in limine<\/em> requests.\u00a0<\/p>\n

The memorandum, penned by SBF\u2019s lawyer Mark Cohen, calls the requests filed by the United States Department of Justice (DOJ) \u201cunfounded and overbroad,\u201d among other things.<\/p>\n

He argues that most of the issues raised by the government cannot be properly addressed at the current stage. Additionally, the memorandum claims the requests \u201cseek to admit irrelevant and\u00a0prejudicial evidence regarding conduct that is no longer or never was charged, to undercut any potential defense, and to admit broad categories of hearsay and other improper evidence.\u201d<\/p>\n

It goes on to argue that the requests from the prosecutor are \u201cunsupported by law and unworkable\u201d in practice and, therefore, shouldn\u2019t be granted. <\/p>\n

This memorandum comes after multiple recent filings from the DOJ asking the court to intervene in various aspects of the case. On Aug. 28, the government filed a motion to bar all of SBF\u2019s expert witnesses<\/a> from testifying in court.\u00a0<\/p>\n

The DOJ argued that all of the proposed experts, along with their accompanying disclosures, \u201csuffer from an array of deficiencies,\u201d warranting being banned from the trial. <\/p>\n

A day later, on Aug. 29, the prosecutor filed another motion that called SBF\u2019s fraud allegation defense \u201cirrelevant\u201d<\/a> in its current state and requested additional disclosures to the already planned defense. <\/p>\n

Meanwhile, SBF\u2019s lawyers have been pushing for a temporary release<\/a>, stating that the accommodations the authorities provided are insufficient for him to prepare for the October trial.\u00a0<\/p>\n

His lawyers are also in the process of appealing the court\u2019s decision to revoke his bail<\/a>, which was decided on Aug. 11. The defense claimed the bail was revoked as a \u201cretaliation\u201d for his exercising First Amendment rights.<\/p>\n
