{"id":156408,"date":"2023-09-15T12:10:44","date_gmt":"2023-09-15T06:40:44","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=156408"},"modified":"2023-09-15T12:10:44","modified_gmt":"2023-09-15T06:40:44","slug":"latest-cftc-enforcement-actions-challenge-core-tenets-of-defi-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/latest-cftc-enforcement-actions-challenge-core-tenets-of-defi-crypto-news\/","title":{"rendered":"Latest CFTC Enforcement Actions Challenge Core Tenets of DeFi &#8211; Crypto News"},"content":{"rendered":"<p>Crypto Advocates Continue To Call For Clear Rules To Support U.S. Web3 Industry and See Path Forward Through Persistent Engagement With Regulators<\/p>\n<div>\n<p>Last Thursday, an <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/cftc-fines-opyn-zeroex-and-deridex\">enforcement action<\/a> by the U.S. Commodities Futures and Trading Commission (CFTC) against three DeFi protocols was the latest event in an ongoing saga of <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/upcoming-congressional-meeting-to-review-two-digital-asset-bills\">legislative battles<\/a>, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/us-judge-tosses-class-action-lawsuit-against-uniswap-labs\">rulings<\/a> by district courts, and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/sec-defi-rule-change\">scuffles<\/a> over rulemaking.<\/p>\n<p>As the CFTC has now ordered Opyn, 0x and Deridex to cease operations that violate the Commodity Exchange Act and CFTC regulations, some of crypto\u2019s prominent advocates are again questioning whether the regulatory landscape is conducive for entrepreneurs looking to operate in the space.<\/p>\n<p>\u201cThis week\u2019s CFTC enforcement actions expose a series of contradictions,\u201d Marisa Coppel, senior counsel at the Blockchain Association, told The Defiant. \u201cFirst, it is in direct conflict with a court\u2019s recent opinion in Risley v. Uniswap, which held that developers were not liable for third-party misuse of their software.\u201d<\/p>\n<p>In late August, a judge <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/us-judge-tosses-class-action-lawsuit-against-uniswap-labs\">dismissed<\/a> a case which alleged that Uniswap Labs and others were liable for losses caused by scam tokens launched by third parties on the Uniswap decentralized exchange.<\/p>\n<p>Coppel also noted inconsistencies within the CFTC itself, pointing towards a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cftc.gov\/PressRoom\/SpeechesTestimony\/opapham9\">proposal<\/a> by Caroline Pham, one of the organization\u2019s five commissioners, to create a pilot program which would allow for supervised experimentation in the digital asset space.<\/p>\n<p>She added that another commissioner, Summer Mersinger, published a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cftc.gov\/PressRoom\/SpeechesTestimony\/mersingerstatement090723\">dissenting statement<\/a>, highlighting that the CFTC did not show that the DeFi protocols in question misappropriated customers\u2019 funds or otherwise caused harm to their users.<\/p>\n<p>The CFTC action comes in a year where markets have been <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/thedefiant.io\/markets-rally-after-u-s-judge-says-ripple-is-not-a-security\">seesawed<\/a> by numerous developments pertaining to crypto regulations.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.linkedin.com\/in\/ashley-ebersole-75a64a4\/\">Ashley Ebersole<\/a>, general counsel at 0x, which paid a $200,000 fine because its Matcha aggregator offered access to leveraged assets, thinks some degree of regulation is inevitable. \u201cWhatever your view of regulation, it\u2019s just a fact of life,\u201d he said in a conversation with The Defiant this week.<\/p>\n<p>Ebersole previously worked at the Securities and Exchange Commission, which has been cracking down on crypto. \u201cThe more successful web3 becomes and DeFi becomes, the more attention it\u2019s going to get and the more there\u2019s going to be a need to engage with regulatory requirements,\u201d he said<\/p>\n<p>Will Warren, the co-founder of 0x, noted the difficulties inherent to regulating crypto.<\/p>\n<p>\u201cTokens are an abstraction that can represent anything,\u201d he said, emphasizing that fitting that abstraction into existing regulatory frameworks is challenging. \u201cThe space as a whole is so broad that it\u2019s hard to map it to a single individual regulatory body.\u201d<\/p>\n<p>Chris Perkins, a member of the CFTC\u2019s Global Markets Advisory Committee (<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cftc.gov\/About\/AdvisoryCommittees\/GMAC\">GMAC<\/a>), thinks the orders highlight the need to interface with key decision makers in the United States. \u201cEducation and engagement of regulatory bodies and policymakers are imperative at this crucial time,\u201d he told The Defiant.<\/p>\n<p>Looking forward, Perkins does see an end to the ambiguous regulatory environment.<\/p>\n<p>\u201cThe good news is that clarity is coming, one way or another \u2013 either through legislation or the courts,\u201d he said. \u201cI just hope that it comes before we lose some of our most talented entrepreneurs to overseas jurisdictions that are literally waving them in.\u201d<\/p>\n<p>Meanwhile, Warren says Matcha has no plans to stop serving U.S. customers. \u201cIt is challenging to operate as a U.S. company and serve users in the U.S., [but] we\u2019re going to do it. Crypto is a global phenomenon.
