Charges include wire fraud, securities fraud and conspiracy to commit money laundering. He studied physics at Massachusetts Institute of Technology (MIT) but often <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/sam-bankman-fried-crypto-billionaire-profile-ftx-exchange-history-investors-2021-12?r=US&amp;IR=T\">joked<\/a> about being \u201cabsolute trash\u201d in college. He then got his start in the industry at Jane Street, a leading trading firm, where he executed arbitrage trades on exchange-traded funds (ETFs). Parlaying those trading skills into the crypto world, he launched Alameda Research, a crypto hedge fund, which <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/crypto-arbitrage-trading-strategy-alameda-research-sam-bankman-fried-billionaire-2021-4?utm_medium=social&amp;utm_source=facebook.com&amp;utm_campaign=sf-bi-main&amp;r=US&amp;IR=T\">capitalized<\/a> on a Bitcoin arbitrage trade between the U.S. and Japan.<\/p>\n<p>Then came FTX, a crypto exchange built by Bankman-Fried alongside Nishad Singh and Gary Wang that aimed to rival the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/crypto-trading-tips-ethereum-outlook-young-billionaire-sam-bankman-fried-2021-5\">\u201cs-\u2013show exchanges\u201d<\/a> Alameda traded on. By late 2021, FTX ranked as the second leading exchange in crypto derivatives after its competitor Binance and had <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/headlines\/ftx-valued-32-billion-series-c\/\">secured<\/a> a valuation of US$32 billion. The exchange had the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.crunchbase.com\/organization\/ftx-exchange\/investor_financials\">backing<\/a> of some of the venture industry\u2019s most venerable players including Sequoia, Lightspeed and BlackRock.<\/p>\n<p>As the crypto bear market took hold, a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coindesk.com\/business\/2022\/11\/02\/divisions-in-sam-bankman-frieds-crypto-empire-blur-on-his-trading-titan-alamedas-balance-sheet\/\">report<\/a> from Coindesk revealed that Alameda Research\u2019s balance sheet contained a significant proportion of illiquid assets, predominantly in FTX\u2019s native token FTT. In response Binance said it would <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/headlines\/binance-ftx-token-holdings-trading-arm-alameda\/\">liquidate<\/a> its FTT holdings, sparking a bank run that <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-11-09\/ftx-investors-told-that-without-more-capital-bankruptcy-likely?leadSource=uverify%20wall\">revealed<\/a> a shortfall in over US$8 billion in customer funds on FTX and ultimately led to the exchange <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/ftx-files-for-bankruptcy-sam-bankman-fried-steps-down-as-ceo\/\">filing<\/a> for bankruptcy.\u00a0<\/p>\n<p>Reports from FTX\u2019s liquidators, regulators and the DOJ allege the exchange significantly lacked corporate controls and oversight. Bankman-Fried has <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/headlines\/sam-bankman-fried-pleads-not-guilty\/\">pleaded<\/a> not guilty to all charges.\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><strong>Judge Lewis A. Kaplan\u00a0<\/strong><\/h2>\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" data-lazyloaded=\"1\" width=\"865\" height=\"1014\" src=\"https:\/\/forkast.news\/wp-content\/uploads\/2023\/09\/Lewis_A._Kaplan.jpg\" alt=\"Lewis A. The 78-year-old judge previously worked as a partner at law firm Paul Weiss in New York before being <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/1994\/05\/08\/nyregion\/clinton-administration-nominates-six-for-federal-judgeships.html\">nominated<\/a> to a Federal judicial position in New York by U.S. President Bill Clinton in 1994. He then <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.courtlistener.com\/person\/1702\/lewis-a-kaplan\/\">secured<\/a> senior status on the bench in 2011.<\/p>\n<p>Kaplan has preceded over many high-profile cases in the U.S. District Court for the Southern District of New York including a civil lawsuit filed by Virginia Giuffrie against the U.K.\u2019s Prince Andrew <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/prince-andrew-abuse-allegations-virginia-giuffre-b2017340.html\">claiming<\/a> he sexually assaulted her on three separate occasions. Andrew tried to dismiss the case, having previously reached a settlement with Giuffrie in 2009, however Kaplan <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theguardian.com\/uk-news\/2022\/jan\/12\/prince-andrew-case-proceed-latest-ruling-virginia-giuffre\">denied<\/a> the request. The case was settled outside of court with Andrew paying an undisclosed sum to Giuffrie.<\/p>\n<p>He also presided over the recent civil case brought by writer E. Jean Carroll against former U.S. President Donald Trump, which accused Trump of raping her in a dressing room in a department store in the early 90s. Jurors <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/jurors-set-deliberate-civil-rape-case-against-donald-trump-2023-05-09\/\">awarded <\/a>Carroll US$5 million, finding that she was sexually abused, but rejecting the allegation she was raped. The office <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-sdny\/about\">represents<\/a> the interests of the U.S. government in criminal and civil matters.<\/p>\n<p>U.S. Attorney Damian Williams is the lead attorney for the office and was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-sdny\/meet-us-attorney\">nominated<\/a> by U.S. President Biden in August 2021. In his previous role as assistant U.S. attorney, Williams primarily investigated and prosecuted cases involving corruption in financial markets and politics, according to the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/usao-sdny\/meet-us-attorney\">agency\u2019s website<\/a>.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.courtlistener.com\/docket\/66631291\/parties\/united-states-v-bankman-fried\/\">Co-leading<\/a> the prosecution against Bankman-Fried for the agency is Assistant U.S. Attorneys Nicolas Roos and Danielle Sassoon. Roos has worked at the U.S. attorney\u2019s office for over seven years, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.linkedin.com\/in\/nicolas-roos-00842338\">according to LinkedIn<\/a>. Partners Mark Cohen and Christian Everdell are co-leading the defense. Cohen <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cohengresser.com\/attorney\/mark-s-cohen\/\">co-founded<\/a> Cohen and Gresser and headed up the firm\u2019s litigation and arbitration group\u00a0 as well as the white collar defense and regulation group. Before co-founding the firm he <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cohengresser.com\/attorney\/mark-s-cohen\/\">served<\/a> as an assistant U.S. attorney for the Eastern District of New York.<\/p>\n<p>Everdell also <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cohengresser.com\/attorney\/christian-r-everdell\/\">worked<\/a> in the U.S. Attorney\u2019s office but for the Southern District of New York before joining Cohen and Gresser. He now <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cohengresser.com\/attorney\/christian-r-everdell\/\">leads<\/a> Cohen and Gresser\u2019s U.S. Privacy &amp; Data Security group and is also a member of the firm\u2019s litigation and arbitration group and white collar defense and regulation group.<\/p>\n<p>The pair recently represented Ghislaine Maxwell in a high-profile criminal case where she was convicted of sex trafficking offenses related to recruiting underage girls for the billionaire financier and sex offender Jeffrey Epstein. She was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/government\/ghislaine-maxwell-be-sentenced-sex-trafficking-conviction-2022-06-28\/\">sentenced<\/a> to 20 years and fined $750,000.<\/p>\n<p>Court filings <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.222.0.pdf\">show<\/a> that for the Bankman-Fried case, the defense is looking to, at least partially, use an \u201cadvice of counsel\u201d strategy. FTX co-founders Gary Wang and Nishad Singh as well as former Alameda Research CEO Caroline Ellison have all pleaded guilty to criminal charges and are cooperating with investigators. They are expected to testify at trial.<\/p>\n<p>FTX Digital Markets Co-CEO Ryan Salame recently <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/headlines\/former-ftx-ryan-salame-pleads-guilty\/\">pleaded<\/a> guilty to criminal charges linked to campaign financing and conspiracy to operate an unlicensed money transmitting business. According to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2023\/09\/07\/technology\/ftx-guilty-plea.html\">the New York Times<\/a>, federal prosecutors have stated that Salame is not cooperating with them in the case against Bankman-Fried. He had a close relationship with Bankman-Fried and Business Insider <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/sam-bankman-fried-crypto-billionaire-profile-ftx-exchange-history-investors-2021-12?r=US&amp;IR=T\">described<\/a> him as a person he was \u201cinstantly very impressed with.\u201d<\/p>\n<p>Bankman-Fried\u2019s father Joseph Bankman could make an appearance at the trial. He previously worked in a part-time role at FTX and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/sam-bankman-frieds-father-retains-attorney-source-2023-01-12\/\">reportedly<\/a> helped set up meetings for his son in Washington D.C. The exchange is currently <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DownloadPDF?id1=MTY1NzA5Mg==&amp;id2=-1\">trying<\/a> to claw back an illegal US$10 million loan made to Bankman-Fried\u2019s father, which liquidators believe has been used to bankroll his son\u2019s legal defense. Bankman also retained his own lawyers, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/sam-bankman-frieds-father-retains-attorney-source-2023-01-12\/\">a report<\/a> from Reuters.<\/p>\n<p>Both Bankman-Fried\u2019s father and mother, who are professors at Stanford University, have stood by him as the case has unfolded. The judge <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/digital-assets\/2023\/08\/31\/bankman-fried-claiming-to-be-overwhelmed-by-prosecution-evidence-has-just-hours-to-seek-trial-postponement\/#:~:text=Sam%20Bankman%2DFried%20has%20until,be%20requested%20by%20September%207.\">set <\/a>this time frame because a jury for the trial needed to be requested by Sep.7.<\/p>\n<p>In the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.uscourts.gov\/services-forms\/jury-service\/juror-selection-process#:~:text=The%20judge%20and%20attorneys%20ask,from%20serving%20in%20that%20trial.\">jury selec<\/a><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.uscourts.gov\/services-forms\/jury-service\/juror-selection-process#:~:text=The%20judge%20and%20attorneys%20ask,from%20serving%20in%20that%20trial.\">t<\/a><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.uscourts.gov\/services-forms\/jury-service\/juror-selection-process#:~:text=The%20judge%20and%20attorneys%20ask,from%20serving%20in%20that%20trial.\">ion process<\/a>, a group of prospective jurors will receive an online questionnaire to fill out and then, in a process known as voir dire, those who are summoned will face more questions from the judge and the lawyers to determine their suitability for jury duty.<\/p>\n<p>On Sept. 11 both <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.273.0.pdf\">the defense<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.590940\/gov.uscourts.nysd.590940.274.0.pdf\">the prosecution<\/a> filed their questions for prospective jurors including questions regarding knowledge of Sam Bankman-Fried, FTX, cryptocurrencies, political donations, effective altruism \u2014 which is a charitable philosophy Bankman-Fried followed \u2014 and ADHD, a medical condition that Bankman-Fried takes medication for.<\/p>\n<p>One of the challenges of this case is its high-profile nature.
