{"id":165728,"date":"2023-09-30T14:55:36","date_gmt":"2023-09-30T09:25:36","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=165728"},"modified":"2023-09-30T14:55:36","modified_gmt":"2023-09-30T09:25:36","slug":"back-from-the-dead-can-ftx-stage-a-comeback-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/back-from-the-dead-can-ftx-stage-a-comeback-crypto-news\/","title":{"rendered":"Back from the dead: Can FTX stage a comeback? &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<p>The reboot of collapsed cryptocurrency exchange FTX, once floated as a joke, could soon become a reality.<\/p>\n<p>Since May, bankruptcy administrators have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/IluTe9M9mp\">contacted<\/a> over 75 bidders as part of a \u201cmarketing process\u201d for FTX.com and FTX.US. Among the options under consideration is a transaction that could result in the relaunch of the exchange(s), according to a September <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/IluTe9M9mp\">stakeholder<\/a> update.<\/p>\n<p>The reboot isn\u2019t a given. Administrators are unlikely to proceed if it could create regulatory concerns or fail to yield value for creditors, according to a draft restructuring plan <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DocketInfo?DocAttribute=4544&amp;DocAttrName=PLANANDDISCLOSURESTATEMENT_Q&amp;MenuID=10244&amp;AttributeName=Plan%20%26%20Disclosure%20Statement\">filed<\/a> in July.\u00a0<\/p>\n<h2 class=\"wp-block-heading\"><strong>A novel concept<\/strong><\/h2>\n<p>Until its collapse, FTX was <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/sam-bankman-fried-ftx-founder-guide-case\/\">popular<\/a> amongst traders and quickly garnered customers. Within three years of launching, it <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/sam-bankman-fried-ftx-founder-guide-case\/\">ranked<\/a> as the second leading exchange in crypto derivatives after Binance. <\/p>\n<p>The reason FTX grew so quickly is that it brought together novel combinations of concepts in derivatives markets from real-time clearing to 24\/7 direct-to-consumer operations, said Brett Harrison, FTX.US\u2019s former president, in a recent <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=SH_jgzGQ8sg\">interview<\/a> with Coindesk. He said this is part of the appeal in restarting the exchange.<\/p>\n<p>Facing a shortfall in customer funds of <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/sam-bankman-fried-ftx-founder-guide-case\/\">over US$8 billion<\/a>, FTX filed for bankruptcy in November last year. Several of the company\u2019s former executives have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/sam-bankman-fried-ftx-founder-guide-case\/\">pleaded<\/a> guilty to criminal charges including fraud and the misappropriation of funds between the exchange and its sister entity Alameda Research. Sam Bankman-Fried, the firm\u2019s founder and former chief executive officer, has <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/sam-bankman-fried-ftx-founder-guide-case\/\">pleaded<\/a> not guilty and will face trial on Oct. 3.<\/p>\n<p>John J. Ray III, who oversaw Enron\u2019s bankruptcy, was appointed as the exchange\u2019s new CEO. Months later, Ray publicly <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/new-ftx-chief-says-crypto-exchange-could-restart-11674143168\">floated<\/a> the possibility of a reboot.<\/p>\n<p>\u201cJohn Ray 3.0 threw all the prior accounting in the trash and rebuilt the numbers from scratch,\u201d said the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/AFTXcreditor\">FTX 2.0 coalition<\/a>, a group of creditors who are for rebooting the exchange, on <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/AFTXcreditor\/status\/1637764551444668416\">X<\/a> (formerly Twitter). \u201cResults confirm: The exchange was a money printer. The problem was that a bankrupt hedge fund robbed it to hide its bankruptcy.\u201d<\/p>\n<p>Alongside profitability, the coalition <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/AFTXcreditor\/status\/1637764551444668416\">views<\/a> increasing competition amongst exchanges as one of the benefits of a reboot. Several members of the coalition did not immediately respond to an interview request. Representatives for the debtors, the unsecured creditor committee and the ad hoc committee, which represents FTX.com creditors, also did not respond to a request for comment on the reboot.<\/p>\n<h2 class=\"wp-block-heading\"><strong>The intricacies of bankruptcy<\/strong><\/h2>\n<p>\u201cYou\u2019re talking about a lot of pieces coming together,\u201d said Thomas Braziel, founder of 117 Partners, a firm that buys crypto bankruptcy claims. \u201cEvery single piece lowers the probability of [the reboot] happening.\u201d<\/p>\n<p>To confirm a bankruptcy plan under U.S. Chapter 11 proceedings, it must meet a set of requirements under Section 1129. A focus point of this section is <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.marcumllp.com\/insights\/feasibility-opinions-in-bankruptcy-plan-approvals\">feasibility,<\/a> Braziel said. A plan for the reboot would need to tackle the feasibility of a range of issues from token lockups to compliance issues such as know-your-customer and anti-money laundering procedures. In many ways FTX would start from scratch, he added.<\/p>\n<p>\u201cI don\u2019t see FTX 2.0 without a plan sponsor,\u201d said Braziel, adding that only around 20 firms could take on an FTX. The bankruptcy of crypto lender Voyager is a \u201cfantastic\u201d case study on why a reboot is unlikely to happen because buyers ran into issues from \u201cshaky balance sheets\u201d to challenges from regulators, he added.<\/p>\n<p>Voyager Digital <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/technology\/crypto-lender-voyager-files-bankruptcy-2022-07-06\/\">filed<\/a> for bankruptcy in July last year, not long after the collapse of crypto hedge fund Three Arrows Capital (3AC). The volatility in the crypto market and a default on a US$650 million loan to 3AC led to the proceedings. The lender is in <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coindesk.com\/policy\/2023\/05\/05\/voyager-digital-plans-to-liquidate-assets-wind-down-after-sale-dreams-crushed\/\">the process<\/a> of winding down after failing to secure deals with both FTX and Binance.US. Crypto lender Celsius Network soon followed suit with its own <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/forkast.news\/celsius-files-for-bankruptcy-after-closing-defi-loans\/\">filing<\/a> for bankruptcy.<\/p>\n<p>Fahrenheit, the winning bidder of Celsius\u2019s assets, is set to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businesswire.com\/news\/home\/20230525005382\/en\/Celsius-Announces-Fahrenheit-LLC-as-Winning-Bidder-to-Manage-New-Entity-to-Be-Owned-by-Celsius-Creditors\">launch<\/a> NewCo, a new company owned by Celsius creditors. It\u2019s a way to manage its illiquid assets such as its mining and staking business lines, rather than a complete reboot. It\u2019s included in Celsius\u2019s current restructuring proposal, which has <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coindesk.com\/policy\/2023\/09\/26\/celsius-bankruptcy-nears-end-as-creditors-approve-reorganization-plan\/\">received<\/a> over 98% creditor approval.<\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-04-18\/ftx-crypto-exchange-restart-plan-draws-interest-from-tribe-capital-vc\">Tribe Capital<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/ftx-begins-talks-on-reboot-as-managers-uncover-past-misconduct-38ad7e3c\">Figure<\/a> have been reported as potential bidders for an FTX restart. Neither company responded to a request for comment.<\/p>\n<h2 class=\"wp-block-heading\"><strong>A token-led recovery<\/strong><\/h2>\n<p>Creditors of FTX.com, its offshore entity, may receive equity, tokens or some other form of interest in the rebooted exchange rather than all cash, according to the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/restructuring.ra.kroll.com\/FTX\/Home-DocketInfo?DocAttribute=4544&amp;DocAttrName=PLANANDDISCLOSURESTATEMENT_Q&amp;MenuID=10244&amp;AttributeName=Plan%20%26%20Disclosure%20Statement\">restructuring proposal<\/a>.<\/p>\n<p>Crypto exchange Bitfinex set a precedent when it issued a recovery token to recoup losses from a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2017-05-17\/inside-bitfinex-s-comeback-from-a-69-million-bitcoin-heist\">major heist<\/a> in 2016. Bitfinex socialized losses across all accounts \u2014 resulting in a 36% haircut per account \u2014 and customers were given recovery tokens instead. Thanks to a bull rally in 2017, a spike in token prices <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/news.bitcoin.com\/bitfinex-bfx-tokens-redeemed\/\">helped<\/a> make creditors whole.<\/p>\n<p>Many reboot advocates look to Bitfinex as a precedent for FTX, but Braziel said that ship has sailed. Unlike FTX, Bitfinex issued the token before entering bankruptcy proceedings.<\/p>\n<p>The token model is only effective if it mimics what would be a likely outcome in court, said Phil Potter, the former chief strategy officer of Bitfinex who oversaw the distribution, on <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/philgpotter\/status\/1591073703928168448?s=12&amp;t=3dIK_dQYAEpJDc-XwcMYqQ\">X<\/a>. Bitfinex was simple compared to FTX, he added.<\/p>\n<p>Bitfinex\u2019s approach stands in stark contrast to the proceedings of Mt. Gox, which was the largest Bitcoin exchange in 2013. The exchange, which <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wired.com\/2014\/03\/bitcoin-exchange\/\">lost<\/a> 800,000 Bitcoin in 2014, is still to return funds to creditors and most recently <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/mt-gox-bitcoin-repayment-delay\">delayed<\/a> its repayment date by a year.<\/p>\n<p>The average timeframe for a U.S. bankruptcy case is around 18 months, Braziel said, adding that the Mt. Gox case has been protracted due to its proceedings occurring in Japan, where nuances such as the absence of interim distributions slow the process compared to U.S. standards. <\/p>\n<h2 class=\"wp-block-heading\"><strong>What about FTT?<\/strong><\/h2>\n<p>Unlike Bitfinex, FTX already issued a token \u2014 FTT \u2014 and under the current restructuring proposal it will be extinguished and holders will not receive any distribution. <\/p>\n<p>The U.S. Securities and Exchange Commission (SEC) has also <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sec.gov\/news\/press-release\/2022-234\">alleged<\/a> FTT is a security. Still, it hasn\u2019t stopped the token\u2019s price from fluctuating, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.coingecko.com\/en\/coins\/ftx-token\">gaining<\/a> over 7.5% in the last 30 days, according to CoinGecko data.\u00a0<\/p>\n<p>\u201cWe need to distinguish between public opinion and real courts,\u201d said Terrence Yang, managing director at Bitcoin investment firm Swan Bitcoin, adding that, while regulators have been critical of FTT, there\u2019s been no formal ruling.<\/p>\n<p>\u201c[FTT] has a very low probability of recovering, longer term,\u201d Yang said. \u201cIt can recover temporarily when the FTX 2.0 reboot launches and if they have some decent press around it and some good branding and marketing but I think it\u2019s tough.\u201d<\/p>\n<h2 class=\"wp-block-heading\"><strong>FTX, HTX, GTX\u2026<\/strong><\/h2>\n<p>Thanks to FTX\u2019s <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/decrypt.co\/114210\/ftx-spent-hundreds-of-millions-of-dollars-on-sports-marketing-on-road-to-bankruptcy\">marketing spending spree<\/a>, and now criminal proceedings, the exchange secured brand recognition, which led to a debate over whether it should be rebranded or not. FTX <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.axios.com\/2023\/05\/23\/ftx-tesla-reputation-rankings-2021\">ent<\/a>ered Axios Harris Poll of America\u2019s most visible brands for the first time this year, however, it ranked 99th out of 100 in reputation.\u00a0<\/p>\n<p>\u201cJust because the name is recognizable, doesn\u2019t mean it can be trusted,\u201d said Alon Goren, founding partner of investment firm Draper Goren Holm. \u201cBut people do like to, from a marketing perspective, say, \u2018Hey, everybody already knows the name. It\u2019s been on stadiums, it was on major league baseball jerseys. So why not? It\u2019s a familiar name.\u2019\u201d<\/p>\n<p>As a brand new industry this is something to be careful about, Goren said. He couldn\u2019t imagine a world where mainstream users trust FTX again.<\/p>\n<p>Some exchanges seem less concerned about links to the tarnished brand. Crypto exchange Huobi <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theblock.co\/post\/250701\/crypto-exchange-huobi-rebrands-to-htx-for-tenth-anniversary\">renamed<\/a> itself to \u201cHTX\u201d for its tenth anniversary. A blog post said H stands for Huobi, T stands for its advisor Justin Sun\u2019s blockchain Tron and X stands for exchange.<\/p>\n<p>The founders of\u00a0 3AC tried to launch a new exchange under the name \u201cGTX\u201d because \u201cG comes after F,\u201d according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theblock.co\/post\/202589\/3ac-zhu-davies-new-crypto-exchange\">a pitch deck<\/a>. After <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theblock.co\/post\/202661\/coinflex-says-new-exchange-with-3ac-founders-wont-use-gtx-name-after-twitter-ridicule\">receiving<\/a> pushback, they said the name was \u201ca placeholder.\u201d<\/p>\n<p>Though most of the focus has been on the reboot, there\u2019s also a chance FTX will be acquired by a former competitor.<\/p>\n<p>\u201cI don\u2019t think there\u2019s much technology there,\u201d Yang said. \u201cPeople who have worked at FTX have talked about how they basically had <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/sam-bankman-fried-crypto-billionaire-profile-ftx-exchange-history-investors-2021-12?r=US&amp;IR=T\">almost<\/a> no engineers. It was smoke and mirrors. I\u2019m not sure how much value there is, to be honest, for a merger or acquisition.\u201d<\/p>\n<p>Braziel said administrators would be better off selling the assets at a granular level but he still expects objections from regulators similar to the Voyager and Celsius cases.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The reboot of collapsed cryptocurrency exchange FTX, once floated as a joke, could soon become a reality.
