Deaton \u2013 a US attorney representing thousands of Ripple investors in the lawsuit against the US Securities and Exchange Commission (SEC) \u2013 does not see how the regulator will prevail.<\/p>\n<p>He described the agency\u2019s claim that it wants faster adjudication than the blockchain enterprise as the \u201cdumbest argument\u201d he had heard. In his view, the SEC\u2019s only option is to prolong its inevitable loss by appealing the court\u2019s decision whenever possible.<\/p>\n<h2>The SEC\u2019s Desperate Tactics<\/h2>\n<p>The lawyer recently <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.crypto-law.us\/the-irony-of-interlocutory-appeal\/\" data-wpel-link=\"external\">published<\/a> an essay depicting the SEC\u2019s potential strategy in the infamous legal battle versus Ripple. According to him, the partial win the crypto firm secured in mid-July has been a significant milestone and will most likely lead to a decisive victory.<\/p>\n<p>Recall that a US Judge <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptopotato.com\/xrp-price-explodes-16-as-judge-rules-in-favor-of-ripple-in-sec-case\/\" data-wpel-link=\"internal\">ruled<\/a> that Ripple\u2019s XRP sales did not constitute an offer of investment contracts. A decision that boosted the price of the digital asset by over 70%.<\/p>\n<p><iframe loading=\"lazy\" title=\"BREAKING: XRP PRICE EXPLODES as RIPPLE WINS HUGE VICTORY AGAINST SEC | CRYPTO WIN!\" width=\"740\" height=\"416\" src=\"https:\/\/www.youtube.com\/embed\/pUTDJAy0Kxs?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe><\/p>\n<p>The SEC, though, did not back down and formally <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cryptopotato.com\/the-regulator-strikes-back-sec-files-to-appeal-ripples-partial-court-victory\/\" data-wpel-link=\"internal\">appealed<\/a> the ruling at the beginning of September. Deaton believes that even if the requests get granted, it will still not be enough for the watchdog to win the case, as Judge Torres will once again rule in favor of Ripple by fully explaining her \u201creasoning.\u201d<\/p>\n<blockquote>\n<p>\u201cShould an early appeal be granted, it will take another year and a half to two years for the US Court of Appeals for the 2nd Circuit to rule on the issue. If the SEC were to win at the 2nd Circuit, which I believe they won\u2019t, then the case gets remanded back to Judge Torres, who would apply the facts of the case to the other Howey factors not yet analyzed.\u201d<\/p>\n<\/blockquote>\n<p>In other words, the agency can appeal the decisions that are not in its favor as long as it has the chance, but they will have no effect on the final resolution. \u201cThe SEC will spitball separate arguments from ongoing cases into its appeal process\u2014delaying litigation across the board. These are the desperate tactics of a regulator who lost the case,\u201d Deaton concluded.<\/p>\n<h2>What Could Happen if Ripple Emerges Victorious?<\/h2>\n<p>Numerous experts have predicted that the outcome of the prolonged lawsuit between the two entities will significantly impact XRP\u2019s price.<\/p>\n<p>One such person is the crypto analyst using the X (Twitter) handle KALEO.
