However, the Founder of Dizer Capital, Yasin Mobarak, believes that the SEC will withdraw its charges against Garlinghouse and Larsen before then.<\/span><\/p>\n<h2>Why The SEC Will Drop Charges Against Ripple Founders<\/h2>\n<p><span style=\"font-weight: 400\">In a <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/x.com\/Dizer_YM\/status\/1709542605963301051?s=20\"><span style=\"font-weight: 400\">tweet<\/span><\/a><span style=\"font-weight: 400\"> shared on his X (formerly Twitter) platform, Mobarak stated that the reason for his prediction is that it is not in the SEC\u2019s interest to have \u201ca trial where their corruption can be exposed.\u201d He further stated that the Commission\u2019s \u201cagenda\u201d is bigger than these two executives.<\/span><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Prediction: The SEC will withdraw charges against <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/bgarlinghouse?ref_src=twsrc%5Etfw\">@bgarlinghouse<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/chrislarsensf?ref_src=twsrc%5Etfw\">@chrislarsensf<\/a> .<\/p>\n<p>It is not in their interest to have a trial where their corruption can be exposed, not to mention their agenda is far bigger than just these two executives. The longer <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/search?q=%24XRP&amp;src=ctag&amp;ref_src=twsrc%5Etfw\">$XRP<\/a> solidifies the\u2026<\/p>\n<p>\u2014 Yassin Mobarak \ud83e\ude9d (@Dizer_YM) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/Dizer_YM\/status\/1709542605963301051?ref_src=twsrc%5Etfw\">October 4, 2023<\/a><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">Garlinghouse and Larsen were joined as co-defendants when the <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.newsbtc.com\/news\/ripple\/xrp-price-surges-is-ripple-winning-the-fight-against-sec\/#:~:text=The%20SEC%20filed%20a%20lawsuit,company's%20platform%20is%20not%20decentralized.\"><span style=\"font-weight: 400\">SEC filed a lawsuit<\/span><\/a><span style=\"font-weight: 400\"> against Ripple in December 2020. The Commission <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.sec.gov\/news\/press-release\/2020-338\"><span style=\"font-weight: 400\">alleged<\/span><\/a><span style=\"font-weight: 400\"> that the executives structured and promoted the XRP sales to finance the company\u2019s business. Additionally, it accused both individuals of effecting \u201cpersonal unregistered sales of XRP totaling approximately $600 million.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Mobarak shares similar sentiments with pro-XRP legal expert Fred Rispoli, who <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/sec-ripple-founders-trial\/\"><span style=\"font-weight: 400\">stated <\/span><\/a><span style=\"font-weight: 400\">that the SEC is unlikely to pursue a trial against them and outlined reasons for his assertion. One of the reasons he gave was that the SEC would not want a situation where its credibility is questioned, which he believes could happen if someone like the former SEC Director <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/sec-to-submit-hinman-speech-brings-new-accusations\/\"><span style=\"font-weight: 400\">Bill Hinman<\/span><\/a><span style=\"font-weight: 400\"> was called to testify.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The SEC filing a motion for an <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.newsbtc.com\/news\/ripple\/sec-asks-file-interlocutory-appeal-ripple-xrp\/\"><span style=\"font-weight: 400\">interlocutory appeal<\/span><\/a><span style=\"font-weight: 400\"> was considered by many as a means to prolong the trial unnecessarily, which <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/ripple-judge-deems-xrp-sale-non-investment-contract\/\"><span style=\"font-weight: 400\">Judge Analisa Torres<\/span><\/a><span style=\"font-weight: 400\"> had reasoned in her order. Following the denial of this appeal, Mobarak believes that the SEC will now move to end this case quickly so it can appeal to the Court of Appeals and \u201ccontinue to sustain this cloud of uncertainty on the whole industry.\u201d<\/span><\/p>\n<\/p>\n<pre style=\"text-align: center\">XRP price drops below $0.52 | Source:<a rel=\"nofollow noopener\" target=\"_blank\" href=\"http:\/\/Tradingview.com\"> XRPUSD on Tradingview.com<\/a><\/pre>\n<h2>SEC Needs An Incentive To Do So<\/h2>\n<p><span style=\"font-weight: 400\">In response to Mobarak\u2019s tweet, another X user <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/x.com\/CherryEmpress21\/status\/1709546507983003834?s=20\"><span style=\"font-weight: 400\">mentioned<\/span><\/a><span style=\"font-weight: 400\"> that it would be surprising if the SEC decided to drop the charges against Ripple\u2019s executives \u201cwithout some incentive from Ripple given to them.\u201d Such an incentive would likely relate to the crypto firm agreeing to a form of settlement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is something that Rispoli had suggested when he <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/sec-ripple-founders-trial\/\"><span style=\"font-weight: 400\">said<\/span><\/a><span style=\"font-weight: 400\"> that the SEC didn\u2019t intend to maintain a suit against Garlinghouse and Larsen but simply wanted to pressure the company into a \u201cweak settlement.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, it is unlikely that Ripple is willing to reach any form of settlement with the Commission as Ripple\u2019s President Monica Lang <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/ripple-president-sec-lawsuit\/\"><span style=\"font-weight: 400\">asserted<\/span><\/a><span style=\"font-weight: 400\"> that her company intends to see the case \u201call the way through.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Moreso, there is no reason why Ripple should be willing to settle, considering that they already scored <\/span><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/bitcoinist.com\/ripple-judge-deems-xrp-sale-non-investment-contract\/\"><span style=\"font-weight: 400\">two major victories<\/span><\/a><span style=\"font-weight: 400\"> against the SEC and seem to have the upper hand now.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ripple<\/span><span style=\"font-weight: 400\"> and its executives will also have it at the back of their mind that the crypto community is looking to this case for clarity, as any judgment will likely set a precedent for how the crypto industry should be regulated.<\/span><\/p>\n<p>Featured image from Bit Stalking, chart from Tradingview.com<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The civil trial of the US Securities and Exchange Commission\u2019s (SEC) case against Ripple and its top executives, Brad Garlinghouse and Chris Larsen, is set to commence on April 23, 2024.
