{"id":170679,"date":"2023-10-09T09:32:21","date_gmt":"2023-10-09T04:02:21","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=170679"},"modified":"2023-10-09T09:32:21","modified_gmt":"2023-10-09T04:02:21","slug":"us-consumer-watchdog-mulls-applying-e-banking-laws-to-crypto-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/us-consumer-watchdog-mulls-applying-e-banking-laws-to-crypto-crypto-news\/","title":{"rendered":"US consumer watchdog mulls applying e-banking laws to crypto &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<div data-v-3d3be88a=\"\">\n<p>The top United States agency for consumer financial protection is considering applying the Electronic Fund Transfer Act (EFTA) to crypto, in an attempt to protect consumers from fraudulent crypto transfers. <\/p>\n<p>Speaking at an Oct. 6 payments <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.brookings.edu\/events\/making-americas-payment-system-work-for-a-digital-century\/\">conference<\/a> by the Brookings Institution think tank, Consumer Financial Protection Bureau (CFPB) director Rohit Chopra said his agency is looking at applying the EFTA to \u201cprivate digital dollars and other virtual currencies.\u201d<\/p>\n<p>\u201cTo reduce the harms of errors, hacks, and unauthorized transfers, the CFPB is exploring providing additional guidance to market participants to answer their questions regarding the applicability of the Electronic Fund Transfer Act with respect to private digital dollars and other virtual currencies,\u201d Chopra said.<\/p>\n<p>Passed in 1978, EFTA is a federal law that protects consumers when they transfer funds electronically, whether by debit cards, ATMs or bank accounts and aims to limit consumer losses from unauthorized transfers.<\/p>\n<figure><figcaption style=\"text-align: center\"><em>Chopra said the CFPB\u2019s crypto-related plans include providing guidance on how existing electronic fund transfer laws apply to crypto. Source: YouTube<\/em><\/figcaption><\/figure>\n<p>The regulations obligate financial institutions to inform consumers of if \u2014 or when \u2014 they are liable for <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/htx-claws-back-stolen-funds-issues-250-eth-bounty\">unauthorized transfers<\/a>. Liability disclosures are meant to be communicated before the first electronic transfer happens on a user account.<\/p>\n<p>The move by the agency comes amid an over 150% <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/crypto-suffered-153-percent-yoy-increase-hacks-scams-q3-immunefi\">year-on-year increase<\/a> in crypto-platform hacks and as the first <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/sam-bankman-fried-ftx-goes-on-trial-week-review\">criminal trial of FTX co-founder Sam Bankman-Fried<\/a> enters its second week who is accused of fraudulently accessing and using customer funds.<\/p>\n<p>The exchange also suffered a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/ftx-hacker-reportedly-transfers-a-portion-of-stolen-funds-to-okx-after-using-bitcoin-mixer\">hack north of $400 million<\/a> in the weeks after its bankruptcy.<\/p>\n<p><strong><em>Related: <\/em><\/strong><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/news\/basel-committee-disclosure-requirements-banks-crypto-assets\"><strong><em>Basel Committee to consider disclosure requirements for banks\u2019 crypto assets<\/em><\/strong><\/a><\/p>\n<p>Chopra added the CFPB will also issue orders to \u201ccertain large technology firms\u201d to gain information on their business practices in regard to the use of personal data and issuing private currency.<\/p>\n<p>Additionally, the agency will look into examining non-banks that offer payment platforms. <\/p>\n<p>Chopra also suggested the Treasury\u2019s Financial Stability Oversight Council should classify some crypto activities as a \u201csystemically important payment clearing or settlement activity.\u201d<\/p>\n<blockquote><p>\u201cThis could provide, for example, other agencies with critical oversight and tools to ensure that a stablecoin is actually stable.\u201d<\/p><\/blockquote>\n<p><strong><em>Magazine: <\/em><\/strong><a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/cointelegraph.com\/magazine\/blockchain-detectives-mt-gox-collapse-birth-chainalysis\/\"><strong><em>Blockchain detectives \u2014 Mt.
