Artists have been dealt a setback in their copyright fight against generative AI firms after a class-action lawsuit against several of the firms was dismissed by a United States judge, citing a lack of evidence.<\/p>\n
In an Oct. 30 order<\/a>, California District Court Judge William Orrick said the copyright infringement suit against generative AI image service Midjourney, art platform DeviantArt and AI firm Stability AI was \u201cdefective in numerous respects,\u201d granting earlier dismissal bids from the firms.<\/p>\n Judge Orrick however allowed a copyright infringement<\/a> claim from one class action member against Stability to go ahead and allowed the class 30 days to attempt to submit an amended suit with more proof.<\/p>\n \u201cEven Stability recognizes that determination of the truth of these allegations \u2014 whether copying in violation of the Copyright Act occurred in the context of training Stable Diffusion or occurs when Stable Diffusion is run \u2014 cannot be resolved at this juncture,\u201d Orrick wrote.<\/p>\n The lawsuit was first filed in mid-January and claimed Stability\u2019s AI model Stable Diffusion scraped billions of copyrighted images without permission \u2014 including those of the artists \u2014 to train the software.<\/p>\n DeviantArt also incorporated Stable Diffusion on its site, possibly copying millions of images from there without a license and violating its own terms of service, the suit alleged.<\/p>\n Related: <\/em><\/strong>Biden administration issues executive order for new AI safety standards<\/em><\/strong><\/a><\/p>\n Orrick said the AI-generated images likely don\u2019t infringe the artists\u2019 copyright as it\u2019s \u201cnot plausible\u201d they\u2019re derived from copyrighted images. He added he\u2019s \u201cnot convinced\u201d unless the class can show the generated images are similar to the artists\u2019 work.<\/p>\n Copyright claims from some class members were dismissed as their images weren\u2019t registered with the Copyright Office \u2014 needed for bringing a copyright infringement suit.<\/p>\n Copyright infringement allegations are central to similar legal actions taken against AI firms such as the Author\u2019s Guild\u2019s class action against OpenAI<\/a>, Universal Music Group\u2019s suit against Anthropic<\/a> and Getty Images suits<\/a> against Stability AI in the U.S. and United Kingdom.<\/p>\n
