Nick Johnson, the lead developer of Ethereum Name Service (ENS<\/a>), accused Unstoppable Domains<\/a> of patenting its open-source innovation regarding \u201cResolving Blockchain Domain\u201d in a Nov. 16 open letter posted<\/a> on social media platform X (formerly Twitter).<\/p>\n

Johnson asserted that Unstoppable Domains\u2019 patent was solely based on ENS-developed innovations without any unique contributions from the rival firm.<\/p>\n

Unstoppable Domains \u2018anti-open innovation\u2019 activities<\/h2>\n

Johnson further explained how Unstoppable Domains\u2019 patenting efforts contradict the principles of open innovation, citing how the rival firm made a recent \u201capplication for reserving names akin to a \u2018Sunrise Phase\u2019 that has been common to the Domain Name Service (DNS) world for many years.\u201d<\/span><\/p>\n

On the other hand, ENS has refrained from patenting its innovations despite being a leader in the space<\/a>, saying its works are \u201cunder open-source licenses\u201d and \u201cpublicly available for anyone to implement.\u201d<\/p>\n

Johnson emphasized the need for Unstoppable Domains to commit legally to donating its first patent under an \u201cunconditional and irrevocable patent pledge,\u201d saying, \u201cPress releases are not legally binding.\u201d Failure to do this, Johnson warned that \u201cENS Labs stands ready to challenge this patent, which we believe is entirely derivative of our inventions; a position we are able and willing to demonstrate.\u201d<\/p>\n

He concluded that the letter was necessary to \u201cemphasize the importance of permissionless innovation and open standards in the web3 ecosystem and to request [Unstoppable Domains] cooperation in ensuring web3 naming continues to be a place for innovation.\u201d<\/p>\n

Unstoppable Domains responds<\/h2>\n

In response, Matthew Gould, the founder of Unstoppable Domains, highlighted his firm\u2019s commitment to driving advancements in web3 naming standards. He emphasized the critical role of collaborative efforts and discussions in navigating the industry\u2019s evolving landscape.<\/p>\n

Meanwhile, Johnson proposed that Unstoppable Domains should extend the openness of their patent licensing beyond ENS, citing models such as patent non-aggression pacts used by companies like IBM.<\/p>\n

However, Gould broadened the scope of the discussion, pointing out the broader industry implications, noting<\/a> that the focus on Unstoppable Domains could easily shift to patents or trademarks from companies in different regions later.<\/p>\n
