{"id":282423,"date":"2024-04-13T04:52:22","date_gmt":"2024-04-12T23:22:22","guid":{"rendered":"https:\/\/dripp.zone\/news\/?p=282423"},"modified":"2024-04-13T04:52:22","modified_gmt":"2024-04-12T23:22:22","slug":"billion-dollar-bank-accused-of-charging-crippling-overdraft-fees-as-customers-launch-5000000-lawsuit-report-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/billion-dollar-bank-accused-of-charging-crippling-overdraft-fees-as-customers-launch-5000000-lawsuit-report-crypto-news\/","title":{"rendered":"Billion-Dollar Bank Accused of Charging \u2018Crippling\u2019 Overdraft Fees As Customers Launch $5,000,000 Lawsuit: Report &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<div>\n<p>A billion-dollar bank in the US is reportedly facing a potential class-action lawsuit for the second time in about three years over allegedly hammering customers with \u201ccrippling\u201d overdraft fees.<\/p>\n<p>Customers LaNita Criswell and LaSheena Neal say Frost Bank\u2019s history of imposing $35 overdraft fees on transactions that do not exceed account balances is in breach of contract and in violation of the Electronic Funds Transfer Act, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.expressnews.com\/business\/article\/frost-bank-s-fees-spark-another-potential-19385122.php\">reports<\/a> the San Antonio Express-News.<\/p>\n<p>The plaintiffs say their proposed class-action lawsuit has at least 100 members seeking $5 million in damages from the billion-dollar lender.<\/p>\n<p>Criswell and Neal say that when a debit card transaction was initiated on accounts with sufficient funds to cover the purchase, Frost went through a customer\u2019s checking account to \u201csequester\u201d funds for payment. But the bank \u201cstill assesses crippling $35 OD fees on many of these transactions and misrepresents its practices in its account contract.\u201d<\/p>\n<p>Frost Bank says it removed the fees in question last summer, and the\u00a0Consumer Financial Protection Bureau (CFPB) recently <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-proposes-rule-to-stop-new-junk-fees-on-bank-accounts\/\">published<\/a> a proposed rule targeting similar so-called junk fees.<\/p>\n<p>In 2021, Frost Bank was hit with a similar lawsuit when San Antonio resident Theodore Woods alleged that the lender practiced \u201cunfair and unconscionable collection of overdraft fees.\u201d Court documents show that the dispute was settled and the case was dismissed in August of 2022.<\/p>\n<p>In June 2022, Frost Bank <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.prnewswire.com\/news-releases\/frost-bank-expands-overdraft-grace-eliminates-nsf-fees-for-consumer-banking-customers-301566457.html\">expanded<\/a> its $100 overdraft grace period to protect participating customers from overdraft fees if they overdraw their checking accounts by as much as $100.
