{"id":398437,"date":"2025-07-14T11:00:47","date_gmt":"2025-07-14T05:30:47","guid":{"rendered":"https:\/\/dripp.zone\/news\/dolce-gabbana-usa-escapes-nft-class-action-lawsuit-crypto-news\/"},"modified":"2025-07-14T11:05:03","modified_gmt":"2025-07-14T05:35:03","slug":"dolce-gabbana-usa-escapes-nft-class-action-lawsuit-crypto-news","status":"publish","type":"post","link":"https:\/\/dripp.zone\/news\/dolce-gabbana-usa-escapes-nft-class-action-lawsuit-crypto-news\/","title":{"rendered":"Dolce &#038; Gabbana USA Escapes NFT Class-Action Lawsuit &#8211; Crypto News"},"content":{"rendered":"<p><\/p>\n<div data-v-46899fb9=\"\">\n<p>The US arm of Dolce &#038; Gabbana has escaped a proposed class-action lawsuit over its parent company\u2019s alleged abandonment of a non-fungible token (NFT) project.<\/p>\n<p>In an <a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/www.courtlistener.com\/docket\/68538051\/35\/brown-v-dolce-gabbana-usa-inc\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"null\">order<\/a> on Friday, New York federal court judge Naomi Reice Buchwald sided with Dolce &#038; Gabbana USA Inc., dismissing the lawsuit because it wasn\u2019t an \u201calter ego\u201d of its Italy-based parent, Dolce &#038; Gabbana SRL.<\/p>\n<p>A group of NFT buyers claimed in a lawsuit <a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/dolce-gabbana-class-action-lawsuit-nft\" title=\"null\">filed in May 2024<\/a> and <a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/www.courtlistener.com\/docket\/68538051\/15\/brown-v-dolce-gabbana-usa-inc\/\" rel=\"noopener nofollow\" target=\"_blank\" title=\"null\">updated<\/a> in September that Dolce &#038; Gabbana and its US arm \u201care effectively the same company\u201d that failed to deliver on its \u201cDGFamily\u201d NFT project launched in 2022 and kept over $25 million from it.<\/p>\n<p>The future of the suit is in doubt as Dolce &#038; Gabbana USA was the sole US-based defendant. The Dubai-based <a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/learn\/articles\/what-are-nfts-and-why-are-they-revolutionizing-the-art-world\" title=\"null\">NFT marketplace<\/a> UNXD Inc. and the Italy-based Bluebear Italia SRL \u2014 the creator of an NFT collection called \u201cinBetweeners\u201d \u2014 were also named as defendants, which the court noted were not served with the complaint.<\/p>\n<figure><figcaption style=\"text-align: center;\"><em>A highlighted excerpt of Judge Buchwald\u2019s order saying she doesn\u2019t think another amended complaint would be sufficiently pleaded. Source: <\/em><a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/www.courtlistener.com\/docket\/68538051\/35\/brown-v-dolce-gabbana-usa-inc\/\" rel=\"https:\/\/www.courtlistener.com\/docket\/68538051\/35\/brown-v-dolce-gabbana-usa-inc\/\" target=\"https:\/\/www.courtlistener.com\/docket\/68538051\/35\/brown-v-dolce-gabbana-usa-inc\/\" title=\"https:\/\/www.courtlistener.com\/docket\/68538051\/35\/brown-v-dolce-gabbana-usa-inc\/\"><em>CourtListener<\/em><\/a><\/figcaption><\/figure>\n<h2>Lawsuit claimed Dolce &#038; Gabbana abandoned NFT project<\/h2>\n<p>The complaint alleged that Dolce &#038; Gabbana and UNXD together made and promoted DGFamily, which would give buyers \u201chigh value\u201d benefits to be delivered over two years at a rate of once per quarter.<\/p>\n<p>Some of the allegedly promised perks were <a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/learn\/articles\/types-of-nft\" title=\"null\">digital outfits<\/a> for the Decentraland metaverse, physical clothing and live events for NFT holders.<\/p>\n<p>However, the lawsuit claimed Dolce &#038; Gabbana \u201cfailed to provide the complete set of benefits they promised\u201d and kept millions of dollars from selling the NFTs.<\/p>\n<h2>US arm argued it wasn\u2019t involved in NFTs<\/h2>\n<p>Dolce &#038; Gabbana USA filed to dismiss the suit in January, arguing that it was a separate entity that couldn\u2019t be tied to the actions of its Italian parent company.<\/p>\n<p>\u201cD&#038;G USA has not entered into any joint venture with UNXD, or any other entity, to sell, advertise, or promote any NFTs,\u201d it argued.<\/p>\n<p>The firm argued that the complaint\u2019s evidence had established that the NFT project originated from its parent company in Italy and that it had not sufficiently alleged ties between the US and Italian firms.<\/p>\n<h2>Lawsuit failed to separate Dolce &#038; Gabbana USA and Italian firm: Judge<\/h2>\n<p>Judge Buchwald said the lawsuit was \u201cplainly insufficient to withstand D&#038;G USA\u2019s motion to dismiss\u201d as it referred to both the US and Italian company \u201cas \u2018Dolce &#038; Gabbana\u2019 and attributes all misconduct to this shared moniker, without differentiating what each entity did.\u201d<\/p>\n<p><em><strong>Related: <\/strong><\/em><a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/nft-sales-volume-h1-2025-dappradar-cryptoslam\" title=\"null\"><em><strong>NFT sales hit $2.8B in first half of 2025 as trading volumes tank<\/strong><\/em><\/a>\u00a0<\/p>\n<p>The amended lawsuit detailed an \u201coverlap in ownership, officers, directors, and personnel\u201d between the two firms, such as sharing a CEO, operating chief and IT and marketing executives, she noted.<\/p>\n<p>However, the suit failed to \u201cprovide specific examples\u201d of how those executives were involved in the NFT project.<\/p>\n<p>\u201cThe Court finds that plaintiff has not adequately alleged that D&#038;G S.R.L. completely dominated D&#038;G USA even if D&#038;G S.R.L. allegedly shared some employees and office space with D&#038;G USA,\u201d Buchwald said.<\/p>\n<p><em><strong>NFT Creator: <\/strong><\/em><a rel=\"nofollow\" target=\"_blank\" data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/magazine\/jack-butcher-nft-royalties-paid-churn-opepen-nft-creator\/\" title=\"null\"><em><strong>Jack Butcher\u2019s no fan of NFT royalties: \u2018You\u2019re getting paid on churn\u2019<\/strong><\/em><\/a>\u00a0<\/p>\n<p><template data-name=\"subscription_form\" data-type=\"crypto_biz\" label=\"Subscription Form: Crypto Biz Newsletter\"\/><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The US arm of Dolce &#038; Gabbana has escaped a proposed class-action lawsuit over its parent company\u2019s alleged abandonment of a non-fungible token (NFT) project.
